Acceptable use and SMS terms

This document has two parts. Part A is the Acceptable Use Policy ("AUP"), incorporated into the Terms of Service. Part B is a set of customer facing disclaimers that Ino Tek Plus Holding should require or strongly recommend each SMS Bridge customer display or acknowledge, because they protect both the customer and Ino Tek Plus from foreseeable, specific legal exposure identified in regulatory_map.md.

Part A: Acceptable Use Policy

Customer, and anyone Customer permits to use its SMS Bridge account, must not:

  1. Send messages without consent. Send any commercial or marketing text message to a recipient who has not provided the consent required under applicable law (see regulatory_map.md for the consent standard in each market). Transactional or servicing messages tied to an existing job or relationship carry a lower consent bar in most markets, but Customer remains responsible for confirming its own basis to send.
  2. Run marketing blasts. Use SMS Bridge to send bulk, unsolicited marketing campaigns to purchased, scraped, or otherwise non-consented contact lists. SMS Bridge is built for one to one field service communication with a company's own customers, not for mass marketing. If Customer wants to run a marketing campaign to its own opted-in customer list, it must still comply with Section 4 and the disclaimers in Part B.
  3. Ignore opt outs. Fail to honour a "STOP," "UNSUBSCRIBE," or equivalent opt out request within the timeframe required by applicable law (for example, Florida's 15 day cure window under its amended Telephone Solicitation Act, sb.flleg.gov, Chapter 2023-150, approved May 25, 2023). SMS Bridge's gate should be configured to record and honour STOP requests automatically; Customer must not override or disable that function to keep texting an opted-out contact.
  4. Send prohibited content. Send content that is fraudulent, deceptive, threatening, harassing, defamatory, obscene, or that violates a third party's rights, or that carriers prohibit under their acceptable use rules for A2P messaging (for example, content related to illegal activity, or high-risk categories such as debt collection, cannabis, or firearms that carriers commonly restrict or require separate registration for).
  5. Circumvent the Company Gate. Attempt to disable, bypass, or reverse-engineer the gating logic that holds inbound complaints from an assigned technician or holds outbound messages from a former assignee after job closure, except through the administrative release workflow the product provides.
  6. Misrepresent the sender. Send a message that disguises or conceals who is texting, or that fails to identify Customer's business where identification is legally required.
  7. Exceed licensed use. Use SMS Bridge outside the scope of the subscription plan purchased (for example, exceeding a message volume tier without upgrading, where volume tiers apply).

Violation of this AUP may result in suspension or termination of the account under the Terms of Service, in addition to any other remedy available to Ino Tek Plus or a third party.

Part B: Customer facing SMS disclaimers

These are disclosures Customer should give to its own end customers and, in one case, its own staff. We recommend building these into the product's onboarding flow so a customer cannot activate a gateway without acknowledging the relevant disclaimer.

B1. Handset relay gateway, unlimited plan requirement

Before you enable the Android handset relay, confirm your company phone number is on an unlimited texting plan with your mobile carrier. The handset relay sends and receives messages like a normal phone on your own SIM card. If your plan is not unlimited for SMS, your carrier may charge you per message or throttle your line once you exceed your plan's included messages. Ino Tek Plus is not responsible for carrier charges arising from your choice of mobile plan.

B2. Carrier API gateway, per message cost disclosure

If you use the registered carrier line (10DLC/A2P) gateway instead of the handset relay, you will be charged for both the $19/month line registration and a small per message carrier fee (approximately $0.005 per message segment at current carrier rates, subject to change by the carrier, not by us). These charges are separate from your SMS Bridge subscription fee and are your responsibility as set out in the Terms of Service. Long messages may be split into multiple segments, each billed separately by the carrier.

B3. No marketing blasts

SMS Bridge is built for direct, consented communication with your own customers about their own jobs, not for mass marketing. You must not upload purchased or scraped contact lists and text them through SMS Bridge. Any marketing message you send must be to a contact who has given the consent required in your market; see your Privacy Policy and Terms of Service, and regulatory_map.md for a jurisdiction-level summary you should have your own counsel confirm.

B4. Consent required, opt out honoured

You are responsible for confirming you have the right to text each contact in your system. When a contact replies STOP, unsubscribe, or a clear equivalent, SMS Bridge's gate will record that and block further outbound messages to that contact automatically. Do not attempt to override this for a contact who has opted out.

B5. Employee notice of the Company Gate

This is not a disclaimer to the end customer, it is a required disclosure Customer must give to its own staff before those staff use SMS Bridge. See employee_monitoring.md for the full analysis and the ready to use "Employee Notice and Consent" template.

Reminder: this is a template. Confirm current carrier per-segment pricing with Telnyx before publishing B2, since carrier rates change, and confirm the exact 15 day figure and any other state-specific cure windows with counsel before relying on B4/B3 as compliant for every US state.
